EB-2 National Interest Waiver

Boston EB-2 Immigrant Visa Lawyers

EB-2 immigrant visas are in the second preference category and require an applicant to go through the labor-certification process. However, the exception to this is if an applicant obtains an EB-2 national interest waiver. In general, an applicant must show that his or her employment would greatly benefit our nation's interests.

If you are interested in an EB-2 national interest waiver visa or believe you qualify for one, contact Tadmor & Tadmor, LLP, at our law office in Worcester, Massachusetts. You can call 508-791-9400 or toll-free at 800-530-7444. Qualifications for an EB-2 Immigrant Visa: National Interest Waiver

The EB-2 immigrant visa is for professional workers who have advanced degrees and people with "exceptional ability" in the arts, sciences or business. Exceptional ability is judged as it relates to the welfare of the United States, including the economy, culture and educational interests of the United States. Applicants seeking a national interest waiver to bypass the labor-certification process must demonstrate an exceptional ability or that his or her employment in the U.S. would greatly benefit the nation's interests to a degree that is greater than a U.S. citizen worker with the same qualifications. An individual can petition for a national interest waiver either on their own, or sponsored by an employer.

There are no statutory factors that specifically set out what qualifies as an employment position serving a national interest. However here are some factors often considered:

  • Effect on wages and working conditions
  • Effect on economy
  • Effect on education
  • Effect on environment and agriculture
  • Effect on housing conditions
